(a)   On occasion the personal data will be disclosed, with the applicant's consent, to third party service providers where applicable as part of the processing and evaluation process.

Rights

The Applicant has the right to request the access, rectification and erasure of the personal data, as well as the restriction of its further processing and the portability of the personal data. Moreover, the Applicant can withdraw consent at any time by contacting privacy@ncts.ie (enclosing a copy of your ID) and object to the processing of personal data at any time for reasons related to its particular situation when the processing is based on legitimate interest.

This Privacy Statement describes how Applus Car Testing Services Ltd ('Applus+', 'We''Us') collects and processes personal data about you, how your personal data is processed, used and protected, in addition to the choices you can make about how We, in our role as data controller, are able to process your personal data.

The present notice applies to all personal data We collect about you as an applicant in relation to the job vacancies promoted by Applus+ and other entities pertaining to the Applus+ Group. 'Personal Data' means any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2.   What Personal Data do We Collect

We collect your personal data from a variety of sources, including information we collect from you directly, for example when you apply for a particular job vacancy, and information We collect about you from other sources such as Fas, Jobs.ie, external recruitment agencies  (to the extent that such information is publicly available and as allowed under the applicable laws).

Please bear in mind that certain personal data, marked as compulsory [using a (*) to mark] shall be required in order for Us to evaluate your application, and thus, We will not be able to continue the recruitment process in those cases where such compulsory data is not provided correctly.

2.1  Personal Data We collect directly from you

The categories of personal data that We collect directly from you include:

  • *Personal details and contact information: name, (maiden name) and surname, e-mail and telephone details, home address, date of birth, PPS Number/ passport / driver´s license and photograph;
  • Other information about you: gender, marital status, hobbies, country of origin,
  • Payroll processing data and compensation details: bank details, base salary, bonus, benefits, tax ID social security number
  • *Right to work/immigration data: citizenship, details of residency or work permit
  • *Work and work history: description of current position, title, salary plan, pay grade or level, unit/department, location, supervisor(s) and subordinate(s), work history to include disciplinary, appraisals etc
  • *Talent, recruitment and application details, education and training details: details contained in letters of application and resume/CV, previous employment background and references, education history, professional qualifications, language and other relevant skills, details on performance management ratings, development plan and willingness to relocate
  • *Psychometric testing as part of application processing

 

 

2.2  Other Personal Data We use about you

We will also be able to collect other personal data about you, as derived from your participation in Our recruitment process, such as for example those obtained during the personal interviews we carry out.

  • Special categories of Personal Data

Some of the categories of information that We collect are considered to be special categories of personal data (also known as sensitive personal data). In particular, We will process personal data that relates to your health such as your medical history, reports on medical diagnoses, injuries and treatment or medical leave, trade union membership, country of origin in order to carry out its obligations in the field of employment, social security and social obligations law and, where necessary, for the establishment or defence of legal claims.

3.   How We use your Personal Data and on what Legal Basis

We use and subsequently process personal data We collect about you on the following legal basis, and for the purposes identified below:

  • To evaluate your application in relation to a particular job vacancy, on the basis of the legitimate interest of Applus+ in this respect. In order to be able to rely on this legitimate personal data processing basis, We have conducted a balancing test to make sure that your interests and fundamental rights or freedoms which require personal data protection do not prevail over Our legitimate interest;

In pursuit of the same purposes listed above, We will allow third party service providers and vendors engaged by Us to access the personal data in order to benefit from their services, as further described in Section 4.

4.   Your Rights Over your Personal Data

You have certain rights regarding your personal data, subject to local law.

In particular, you are entitled to receive confirmation from Applus+ acknowledging whether or not it is processing your personal data and, where applicable, to request access to the personal data and also to certain information about the processing (e.g. purposes, categories of the personal data subject to processing and recipients etc.) (right to access). You are also entitled to request the rectification of inaccurate personal data (right to rectification) and the erasure of your personal data when, among other reasons, they are no longer necessary for the purposes for which they were collected (right to erasure). In specific cases (e.g. if the data subject challenges the accuracy of the personal data, while this is being checked), you can request a restriction on the processing of your personal data, which can only be processed to file or defend claims (right to restriction of processing). Finally, you can also exercise the right to data portability, i.e. receive the personal data in a structured, commonly used and machine-readable format, and the right to transmit such data to another controller without hindrance from the controller to which the personal data have been provided where legally permitted for such purposes (right to data portability).

In addition to the aforementioned rights, you are also entitled to withdraw the consent you may have granted to a specific processing, at any time, as well as to object, to the processing of your

 

personal data for reasons related to your particular situation, to our processing of your personal data based on our legitimate interests or those of a third party, in which case We will cease in processing your personal data unless We are able to rely on legitimate reasons to do so.

5.   How do We share your Personal Data and With Whom

Applus+ will be able to share your personal data with third parties under the following circumstances:

  • Service providers. We will allow our service providers that perform IT, recruitment-related services and other business operations for us to access to your personal data in order to carry out data processing activities necessary to support the purposes described in Section 2 of this Privacy Statement.. We enter into a written agreement which requires them to refrain from making any further unauthorized disclosures of the personal data, to use the personal data only for the purposes of providing the specific services and according to the instructions received from Applus+, to only retain the personal data as required to fulfill such purposes of protecting our interests, and to have in place adequate and appropriate security measures.

Because We operate as part of a global business, the recipients referred to above can be located outside the jurisdiction in which you are located (or in which we provide the services), including third countries outside the European Union ("EU") that are not regarded as providing an adequate level of protection of the personal data. 6.   How do we protect your Personal Data

We implement technical and organizational measures to ensure a level of security appropriate to the risk to the personal data we process. These measures are aimed at ensuring the on-going integrity and confidentiality of personal data. We evaluate these measures on a regular basis to ensure the security of the processing.

 

7.   For how long do we Store your Personal Data

 If your application is successful, we will retain your personal data for the duration of your employment with Applus+ and for a period of 7 years thereafter.  Otherwise, we will keep your personal data for a  for a period of 12 months thereafter. We will only retain your personal data after this time if We are required to do so to comply with the law, or if there are outstanding claims or complaints that will reasonably require your personal data to be retained.

8.   International Data Transfers

Your personal data may be transferred to, stored, and processed in a country that is not regarded as ensuring an adequate level of protection for personal data under European Union law.

We have put in place appropriate safeguards (such as contractual commitments) in accordance with applicable legal requirements to ensure that your data is adequately protected, on the basis of the relevant sets of standard contractual clauses approved by the European Commission. For more information on the appropriate safeguards in place, please contact us at the details below.
